These Terms of Use (the "Terms") constitute an agreement between you as a user ("Customer", "You") and the owner of the Needle VPN service ("Service", "We").
Needle VPN is a mobile application for Android, created for those who value their personal space online. We help our users preserve their privacy and security when accessing the internet.
This Service is NOT intended for use for the purpose of carrying out any unlawful activities. The Service provides solely the means of ensuring privacy and of bypassing restrictions imposed by third parties on individual websites and network services.
By installing and using the Needle VPN application, you confirm that you have read these Terms in full, understand their meaning, and agree to comply with them. If you do not agree with even a single provision of these Terms — do not install the application, or delete it and stop using the Service.
1.1. You agree not to violate the applicable laws of your country and of the country in which you are physically located at the time of using the Service. You are responsible for the compliance of your actions with applicable law.
1.2. You undertake to protect the data that provides access to your account (email, one-time codes, session JWT tokens) from unauthorized use by third parties and not to disclose it to third parties. You bear full responsibility for all actions performed using your account.

1.4. You agree not to attempt reverse engineering, decompilation, or disassembly of the Service's infrastructure, its protocols, servers, or application beyond what is permitted by applicable law (for example, for the purpose of ensuring interoperability).
1.5. You agree not to use the Service for commercial purposes (reselling subscriptions, providing third parties with access to your account, selling VPN configurations, and the like) without the prior written consent of the Service.
1.6. You agree not to use the Service to distribute information related to terrorist or extremist activity, including:
Violation of the requirements of this clause constitutes grounds for the immediate blocking of the account and the transfer of information about the user to the competent authorities of the states holding jurisdiction over that user or over the injured party, in the cases provided for by applicable law — including the law of the user's country of residence, the country in which the Service is registered, the country in which the acts were committed, and international legal instruments.
2.1. The cost and frequency of the subscription are specified in the application and on the Service's website. Prices and plans may change from time to time; any change applies only to new subscriptions and does not affect ones already in effect.
2.2. New users may receive a trial period (free or at a reduced cost). The conditions of the trial period (duration, cost) are specified at the time of sign-up.
2.3. Refunds. The Service refunds payments for paid subscriptions provided that no more than 7 (seven) calendar days have passed since the payment. To request one, contact support by any convenient means and state the email address the account is registered to. Requests submitted after that period are not granted, except in cases directly provided for by applicable law.
3.1. We make reasonable efforts to keep the Service available continuously. Nevertheless, planned and unplanned interruptions in operation are possible from time to time, related to technical maintenance, updates, equipment failures, problems on the side of third-party providers (hosting, DNS, payment systems), actions of government regulators, force majeure, and other factors beyond our direct control.
3.2. The connection speed through the VPN tunnel and the quality of bypassing DPI blocking depend on many factors: the bandwidth of your internet connection, the distance from our servers, the current network load, the actions of your internet service provider in managing traffic, and the use of active countermeasures by regulatory authorities. We cannot guarantee specific speed figures or a percentage of successful bypass for any particular target.
3.3. The geographic availability coverage of the Service may change — individual servers may be decommissioned or replaced without prior notice.
3.4. We reserve the right to introduce restrictions on the use of the Service (including limits on speed, traffic volume, and the number of simultaneous connections) in order to ensure quality of service for all users and to protect the Service from abuse.
4.1. We reserve the right, without prior notice, to suspend or terminate your access to the Service in the event of:
4.2. In the event of termination of access on the grounds provided for by clause 4.1, no refund is made for the unused subscription period.
4.3. You may stop using the Service and delete your account at any time, either yourself through the corresponding section of the app or by sending a request to the contact email.
5.1. The Needle VPN application, its source code to the extent not published under free licenses, the trade name, logos, and other designations are the property of the owner of the Service.
5.2. Use of the Needle VPN application does not transfer to you any intellectual property rights to its components beyond what is expressly provided for by these Terms and the applicable licenses of the open-source components.
6.1. The Service is provided "as is" and "as available", without any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement of the rights of third parties.
6.2. We are not liable for the loss of data or messages, interrupted connections, undelivered packets, or other adverse consequences related to the operation of the Service, including those caused by factors beyond our control (failures of third-party services, actions of regulators, problems with your internet connection, etc.).
6.3. To the maximum extent permitted by applicable law, the total aggregate liability of the Service to a particular user on all grounds is limited to the amount actually paid by that user for a subscription during the last 12 months preceding the grounds for the claim.
6.4. The Service is not responsible for the content of third-party websites and services that may be accessed through the application, nor for the actions of users in relation to such websites and services.
7.1. We have the right to make changes to these Terms from time to time. Material changes will be announced by a notification within the application, by publishing the updated version on the Service's website, and where necessary by a separate email notification.
7.2. Between the moment of publishing the updated version and the moment it takes effect, we leave at least 14 calendar days, during which you may stop using the Service and request a proportional refund if you do not agree with the changes.
7.3. Continued use of the application after the new version of the Terms takes effect signifies your agreement to that version.
8.1. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
8.2. The inability to exercise any right provided for by these Terms does not mean a waiver of that right in the future.
8.3. These Terms apply together with the Needle VPN Privacy Policy. By using the application, you agree to both documents simultaneously.
